UNFAIR TREATMENT?
The prosecutors in the Roger Stone case were pressured by senior Justice Department officials to recommend a more lenient sentence. Aaron Zelinsky one of the four prosecutor was told by U.S. Attorney Timothy Shea, that he was receiving “heavy pressure from the highest levels of DOJ to cut Stone a deal”.
William Barr Attorney General, has consistently weighed in on cases in ways that appear to benefit the President. The four prosecutors won the Roger Stone case and had made a sentencing recommendation of 7 to 9 years. The document outlined all the antics and attempted obstructions and the memo said he deserved every day.
It took two days for a response from the supervisors, which ordered them to drop the enhancements they had in the draft. The result of which would reduce the sentencing range. When the prosecutors resisted, their supervisor told them to recommend a lower sentence than the published sentencing guidelines. The prosecutors wrote back to his supervisor “U.S. attorney had political reasons for his instructions. When our supervisor agreed, they were unethical and wrong”. Zelinsky goes on to write “we were instructed we should go along”.
The prosecutors refused to modify the sentencing recommendation and were allowed to submit it. On February 10th Trump exploded on twitter, calling the sentence “horrible and unfair”
When Zelinsky was told the Justice Department would file a new sentencing memo, the four prosecutors all withdrew from the case. On February 20th, Stone was sentenced to only three years and four months in prison with a large tattoo of Richard Nixon on his back.
Are there two sets of justice? What happened to “Equal Justice Under Law” the words etched on the façade of the female statue of justice holding a shield and a sword at the Supreme Court. Donald Trump insists on loyalty, and for this his friends and allies get a treatment to rise above the law something no other citizen can obtain.
Career public servants are now corrupt and the stench is overwhelming. Barr spun the Muller Report and interfered with the Flynn case. Is there no one willing to reign this President? Congress must get its courage to determine what Barr and Trump are doing to the Constitution.
Protesters are saying nothing more than wanting to get equal protection under law, to be able to air their grievances and have someone actually listen to them and do something.
The June 24th testimony of Aaron Zelenski said Stone was treated differently. He is going to testify “What I heard—repeatedly—was Roger Stone was being treated differently from any other defendant because of his relationship to the president….we were instructed that we should go along with the U.S. Attorney’s instructions, because this case was “not the hill worth dying on” and we could “lose our jobs” if we did not toe the line”.
Prosecutors are taught that you must “ prosecute without fear or favor”. There were 65 members of the faculty of George Washington University that signed a statement saying Barr had besmirched the reputation of the University and have recommended he lose his honorary doctorate degree. They highlighted his involvement in the Muller investigation, his interference in the Flynn and Stone cases, and his involvement in the Lafayette Square incident.
During the hearing one comment from Fmr. Deputy Attny General Donald Arye said, “the greatest threat to the rule of law is William Barr. He has shown he does not have the belief that no one is above the law which is the foundation for the rule of law.”
Mr. Barr is inappropriately using the shield of justice in this case. He has also been using the sword of justice in pursuit of anti-trust corporate cases with entities Trump distain for.
